Reports to: Deputy General Counsel

What you’ll be doing:

As Associate General Counsel, Employment, you will join our well-established legal team that supports Enova’s diverse product offerings with a focus on ongoing transactional matters in the US, Australia, Brazil and Canada. You must be nimble and professional to provide timely, pragmatic and business-savvy responses to stakeholders.

We are looking for a dynamic employment attorney who is able to wear both the “attorney hat” and the “HR hat” to assist our team. Reporting directly to the Deputy General Counsel, our ideal candidate has been in-house before and understands how to change and wear these hats seamlessly as required by the business. Key to this role is a fundamental understanding of anti-discrimination laws, ADA, FMLA/medical leave laws/workers compensation, wage and hour, employee benefits and regulatory employment requirements. This attorney will have to navigate these laws in day-to-day situations, as well as be able to draft policy, employment agreements and consulting agreements (and negotiate those agreements) and generally provide advice and counsel to the HR team. This attorney will need to be quick on their feet and be comfortable giving advice in real-time while partnering closely with the HR team. This attorney will also need to be organized, tracking legal requirements by state, like training requirements. Ideally, this attorney will be a strategic thought-partner to the HR team and the executive team and guide the culture of the company.

Your core priorities will be to:

  • Analyze, apply and ensure compliance with employment laws, regulations and policies across jurisdictions to day-to-day situations.
  • Participates in and influences the decision-making process with appropriate clients and stakeholders.
  • Educates clients and stakeholders on legal matters, policies and procedures.
  • Identifies and assesses legal risks and opportunities within the labor and employment area and advises accordingly.
  • Navigate wage and hour issues related to hourly employees.
  • Analyze and advise with respect to classifications of employees as exempt/non-exempt and as independent contractors.
  • Assist with employee benefits and regulatory requirements (e.g., ACA compliance).
  • Manage and/or conduct internal investigations of employee complaints.
  • Review and update current employment-related templates and assist in the drafting of new agreement templates, as needed.
  • Assist with creating, drafting and updating employment policies and processes.
  • Identify and advise with respect to onboarding, inclusive of background checks, offer letters, employment agreements, confidentiality agreements and other new hire documentation.
  • Liaise with regulatory and compliance counsel to ensure compliance with applicable laws and regulations.
  • Manage outside counsel on various matters, including employment litigation, as necessary to accomplish legal and compliance objectives.
  • Respond to and/or manage charges/complaints with federal and state agencies.
  • Assist with employment-related due diligence for transactions, including reviewing NDAs, employment agreements, option award agreements and other documents as needed.
  • Advocates Enova’s interests in relevant matters.

What you should have:

  • A Juris Doctorate from an accredited law school and admittance in good standing with at least one state bar. 
  • Experience at a law firm and as in-house counsel. 
  • The ability to analyze state, federal, and international law and provide detailed recommendations to business partners.
  • Friendly, approachable and able to be a trusted advisor to both the HR team and the executive team on issues related to employment law.
  • A good sense of judgment along with the ability to assist the company in making difficult decisions.
  • Proactive – looking for ways to improve process and policy.
  • Comfortable navigating issues surrounding both hourly and salaried employees.
  • Strong negotiation and drafting skills.
  • High level of accuracy and attention to detail.
  • Good research and organizational skills.
  • Excellent communication skills.
  • Team player - willing to assist with overflow work in other areas of the legal team as needed.
  • The capability to analyze problems and craft a solutions-oriented approach.
  • The ability to engage individuals and teams to ensure timely project completion.
  • The capacity and flexibility to develop new areas of expertise and the confidence to quickly learn and develop independence in key practice areas.
  • Interest in developing an in-depth understanding of consumer financial services and industry is a must.
  • Experience working directly with business partners.
