Job Description
Under the direction of a Director, Senior Counsel, the Counsel – Privacy and Security is responsible for handling various legal matters and projects in support of the Discover privacy and information security programs.
Responsibilities
- Provides legal coverage for privacy and information security programs, including GLBA Privacy and Safeguards, customer authentication, the Red Flag Program, CCPA/CPRA, and other local, state, federal and non-US (e.g. GDPR). This includes transactional work, vendor management, and project-related work. Participates on various working groups and committees related to areas of coverage.
- Exercises prudent discretion and decision-making capabilities to provide legal advice, direction, and support to internal business clients, including risk, compliance, governance, government relations, and legal advice on new initiatives, business processes, contract review and analysis, training, corrective actions, compliance with laws, regulations, policies and procedures, litigation risk, and issues raised in governance committees.
- Identifies, assesses, and communicates information to business clients related to emerging regulatory topics and best practices, and provides oversight and strategic guidance on new or proposed legal and regulatory requirements, emerging legal and regulatory risks, and trends.
- Communicates effectively with clients, customers, leadership, committees, regulators, and counterparties as applicable.
- Manages resources, if assigned, including overhead, outside counsel, and other budgets to achieve Law’s financial goals.
- Continually improves and adheres to required standards and process to promote a risk-aware culture and ensures efficient and effective risk management.
Minimum Qualifications
At a minimum, here’s what we need from you:
- J.D.
- 6+ years of experience in Consumer financial services (including credit card, mortgage, student loans and deposit products) or related
- Active law license in good standing
Preferred Qualifications
If we had our say, we’d also look for:
- 2+ years of experience as a privacy or data protection lawyer in consumer financial services or technology gained at a financial institution, regulatory agency or law firm.
- Strong knowledge of GLBA, Reg. P, CCPA/CPRA, FCRA (Reg. V), GDPR, and applicable data protection state laws and regulations
- Business-oriented professional with solid analytic skills and a proven ability to handle multiple complex matters simultaneously.
- Excellent interpersonal skills, and the ability to build and foster relationships
- Ability to communicate effectively both verbally and in writing with all levels of the organization including senior management and regulators.
