Primary Responsibilities:
- Positions in this function provide legal advice and services on issues concerning the rights, obligations, risks and privileges of the organization
- Protect the pharmacies' rights in contract negotiations and disputes
- Support pharmacy business clients in drafting, managing, reviewing, and revising agreements, statements of work, and amendments with pharmaceutical manufacturers, payors and PBMs, customers, data aggregators, vendors, and other strategic partners
- Review manufacturers' and their vendors' consent forms, letters, telephone call scripts, and other communications to pharmacy patients to ensure their compliance with applicable laws, regulations, and organizational policies
- Provide effective advice and counsel on regulatory and transactional matters to the leaders of Optum Frontier Therapies and other Optum integrated pharmacies
- Acquire deep knowledge of the pharmacy industry and the specific business practices of the Optum integrated pharmacy business within UnitedHealth Group so as to best advise the pharmacies' senior business leaders
- Supports Deputy General Counsel with management of strategic projects that involve multiple OptumRx integrated pharmacies
- Supports OptumRx Compliance team with responses to requests for information from state Medicaid agencies and their contractors
- Provides a full range of legal advice and services and may specialize in one of more areas such as transactional work, commercial law, contracts law, regulatory matters, and healthcare compliance

Required Qualifications:

- Juris Doctorate degree with Bar admission in at least one state
- 7+ years of legal experience in health care regulatory and transactional practices, including deep understanding of the specialty pharmacy dispensing and distribution industries
- Experience advising business leaders on compliance with various health care laws and regulations, including the Federal Anti-kickback Statute, the False Claims Act, the Health Insurance Portability and Accountability Act ("HIPAA"), Medicare regulations, as well as state Medicaid laws, regulations, and policies
- Familiarity with the requirements and procedures of regulatory agencies, particularly with state Boards of Pharmacy, state Medicaid agencies, CMS, and state insurance departments
- Demonstrated understanding of business problems related to assigned legal projects
- Demonstrated capability to build and maintain rapport with superiors, peers, subordinates, and external company contacts, with full capability to lead and contribute to team effort
- Demonstrated ability to evaluate and determine appropriate legal course of action to meet business unit needs
- Demonstrated ability to review and revise contracts in a timely manner with flexibility for more urgent turnaround times
- Demonstrated ability to provide presentable, correctly formatted templates and other external-facing documents to the business' external company contacts
- Demonstrated well-developed written and verbal communications skills
- Proven proactive project management, prioritization, and organizational skills
- Proven excellent presentation skills
- Proven ability to provide brief, well-rounded answers to legal and regulatory questions from the business
Preferred Qualifications:

- 10+ years of legal experience in health care regulatory and transactional practices within the managed care legal environment
- Legal experience working with a state or federal healthcare regulatory agency, i.e., CMS, NIH, FDA, Board of Pharmacy, OIG or DEA
- Business or legal experience with specialty pharmacy operations and/or pharmacy wholesale distribution
- Experience with negotiation of contracts with pharmacy supplier, vendor and technology entities
- Experience with the negotiation of intellectual property rights, uses, licenses, and restrictions
- Solid understanding of health insurance and/or managed care industry, particularly the regulatory framework for pharmacy benefit management entities
- Familiarity with the legally permissible uses and legally required handling of protected health information (PHI) under HIPAA and state privacy laws
