Job Description

Opportunity at a Glance

The Senior Corporate Counsel (Marketing) provides legal counsel and guidance on communications, marketing and advertising reporting to the VP, Deputy General Counsel. This role involves ensuring compliance with federal, state and international regulations, reviewing marketing materials and advising on consumer protection issues.  They will join a team of versatile professionals who work closely together serving the needs of a complex, highly regulated international organization.  In addition to handling a diverse and challenging array of matters supporting Covista's educational institutions, they will also provide legal support to one or more operating divisions and/or additional functional departments of the organization. Qualified candidates will exhibit exceptional experience, and a practical, solution-driven, business-based approach to problem solving and exceptional interpersonal skills that facilitate prompt, constructive solutions for operational personnel and executives across the organization.

Responsibilities

  • Provide ongoing legal counsel and guidance on all marketing and advertising matters for the Covista family or educational institutions.  
  • Create a proactive strategy to ensure compliance with existing and contemplated federal, state and international laws and regulations.  
  • Review and approve marketing content for compliance with applicable laws including FTC regulations, CAN-SPAM Act, and applicable advertising laws.  
  • Perform legal and regulatory compliance risk assessments, propose creative solutions where applicable, and help advance business objectives.  
  • Lead a group of colleagues who conduct an initial review of all marketing and external facing materials.  
  • Manage escalations, collaborate across other teams and develop solutions to enable business partners to achieve their goals.  
  • Update and manage the claims library and be the first point of contact for inquiries from the internal team.  
  • Provide legal guidance on sweepstakes, contests and promotional campaigns, ensuring adherence to state, federal and international regulations.  
  • Advise marketing teams on social media and testimonial issues, including disclosure requirements and endorsement guidelines.  
  • May provide legal counsel and guidance to one or more institutions of the organization on operational matters.  
  • May advise one or more additional functional departments of the organization on the legal implications of their activities.  
  • Completes other projects and duties as assigned.
  • Performs other duties as assigned.  
  • Complies with all policies and standards

Qualifications

  • J. D. from an accredited law school required.
  • 3+ years in-house legal experience required.  
  • 7+ years substantive law firm and/or in-house legal experience preferred.
  • Experience advising in a regulated environment required.
  • Expertise in risk management, compliance, and regulatory frameworks as they relate to marketing and advertising required.
  • Experience managing multiple projects in fast-paced environment with attention to detail.
  • Experience providing guidance of regulations and industry guidelines applicable to mobile, social media, and traditional marketing, including CAN-SPAM, CCPA, COPPA, GDPR, TCPA, the FTC Endorsement and Testimonial Guidelines and telemarketing sales rules.
  • Must be in good standing with the Illinois State bar.
  • Excellent client management and communication skills; both oral and written.
  • Excellent interpersonal skills with the ability to work well in a fluid/fast-paced, highly collaborative, team environment.
  • Strong problem-solving skills with the ability to quickly assess potential for risk and opportunity.
  • Possesses strong work ethic and customer service orientation and ability to prioritize conflicting demands from multiple business clients.
  • Ability to work effectively with all levels of management, to manage multiple projects simultaneously, exercise sound judgment and work independently and efficiently, and meet deadlines with consistently high-quality work product in a fast-paced environment.
  • Must be a proactive self-starter with strong leadership skills.

Additional Information

In support of the pay transparency laws enacted across the country, the expected salary range for this position is between $150,171.61 and $181,034.70. Actual pay will be adjusted based on job-related factors permitted by law, such as experience and training; geographic location; licensure and certifications; market factors; departmental budgets; and responsibility.
